Notsold.co.uk
Terms of business
01Who we are
Notsold.co.uk is a trading name of ARSEA LTD, a company registered in England and Wales, company number 10420699. Our registered office is Camburgh House, 27 New Dover Road, Canterbury, Kent CT1 3DN. VAT number GB253369689. ARSEA LTD is a member of the Property Redress Scheme, membership number PRS008911.
In these terms, "we", "us" and "our" mean ARSEA LTD, and "you" means the person booking the service. Our service is for homeowners acting for themselves, not for businesses.
02Our services
Online Consultation, £195 including VAT (£162.50 plus £32.50 VAT). A 45 to 60 minute video call. Before the call we review your listing, photographs, description, floorplan, asking price and competing homes nearby. Afterwards we send a short written summary of the key actions.
Property Visit, £295 including VAT (£245.83 plus £49.17 VAT). A 60 to 90 minute visit to your home, covering everything in the online consultation plus a room-by-room look at presentation, kerb appeal, layout and staging. Afterwards we send a full written report with local market data and a price opinion.
Property visits cover homes within around 45 minutes' drive of Ashford, Kent. If you are further away, we will tell you about any travel charge before you pay. Online consultations are available anywhere in the UK.
03What our service is not
We give you an independent second opinion. Under this service we do not act as your estate agent, we do not sell, market or manage your home, and we do not act for any buyer.
Any price opinion we give is a market appraisal. It is not a formal valuation (such as a RICS Red Book valuation), a building survey, or legal, financial, tax or mortgage advice. We cannot guarantee that your home will sell, or sell at a particular price or by a particular date.
04Booking and payment
All prices include VAT at the current rate. You pay the full fee by card when you book, through our payment provider, Stripe. We do not see or store your card details. You will receive a payment receipt and a VAT invoice by email.
Your contract with us starts when we email you to confirm your appointment time. We aim to do this within one working day of your payment. If we cannot offer a time that suits you, we will refund you in full.
There are no extra charges beyond the fee shown when you book, unless we have agreed a travel charge with you in advance.
Refunds are paid to the card you paid with, within 14 days of us agreeing the refund.
05Your 14-day right to cancel
Because you book online, you have the legal right to cancel within 14 days of the day your contract starts, without giving a reason. This is your right under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
Starting within the 14 days. Most clients want their consultation or visit as soon as possible, which usually falls inside the 14-day period. When you book, you ask us to start the service within the cancellation period. Our work starts with preparation, such as reviewing your listing and the local market, before your appointment.
- If you cancel before we have started any work, we refund you in full.
- If you cancel after we have started but before the service is complete, we refund you less a fair amount for the work we have done up to the time you tell us.
- Once the service has been fully provided, meaning your consultation or visit has taken place and we have sent your written summary or report, you no longer have the right to cancel.
How to cancel. Email enquiries@notsold.co.uk with your name, booking reference and a clear statement that you wish to cancel. You may use the model cancellation form at the end of these terms, but you do not have to. You only need to send your message before the 14 days end.
We will refund any amount due within 14 days of receiving your cancellation.
06Rescheduling and late cancellation
You can rearrange your appointment once, free of charge, if you give us at least 24 hours' notice.
After the 14-day cancellation period has ended, these rules apply:
- With at least 24 hours' notice, we will rearrange your appointment or refund you in full.
- With less than 24 hours' notice, or if you miss an online consultation, the fee is non-refundable, although we will try to offer you another time.
- If we arrive for a property visit and cannot get in, or no adult is there to meet us, this counts as a cancellation with less than 24 hours' notice.
This section does not affect your rights under section 05.
If we need to cancel or rearrange, for example because of illness or severe weather, we will offer you a new time or a full refund, whichever you prefer.
07What we ask of you
- Give us accurate information about your home, asking price, time on the market, offers received and agent's marketing. Our advice relies on it.
- Make sure you own the property or have the owner's permission to book.
- For a property visit, make sure an adult is present, that we can get in safely, and tell us in advance about any hazards or animals.
08Your report and how it may be used
Your written summary or report is prepared for you alone, to help you decide how to price, present and market your home. You may share it with your estate agent and members of your household.
It must not be relied on by anyone else, including buyers, lenders or other agents, and it must not be used for mortgage, probate, tax, divorce or other legal purposes. Copyright in the report stays with us.
09Referral fees and recommendations
If you ask us to recommend an estate agent or another property professional, such as a stager, photographer or EPC assessor, we may receive a referral fee from that business. You are under no obligation to use any business we recommend, and you are free to choose anyone you wish. We will tell you if a referral fee applies before we make an introduction.
10Independence
Our advice is independent. We receive no payment from your current estate agent, and we have no arrangement that requires us to recommend one agent over another.
11Our responsibility to you
We will provide our service with reasonable care and skill. Our advice reflects the information you give us and market conditions at the time. Markets change, and we cannot control how buyers, agents or others act.
Provided we have acted with reasonable care and skill, we are not responsible for:
- the price your home sells for, or how long it takes to sell;
- the actions of your estate agent, buyers or other third parties;
- decisions you make about your sale, such as changing your price, agent or marketing;
- any loss we could not reasonably have foreseen when you booked;
- any business loss, since our service is for your private use.
Our total liability to you for any claim connected with the service is limited to the fee you paid.
Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited by law. These terms do not affect your statutory rights, including your rights under the Consumer Rights Act 2015.
12Complaints and redress
If you are unhappy with our service, please email enquiries@notsold.co.uk. We will acknowledge your complaint within 3 working days and send a full response within 15 working days.
If you are not satisfied with our final response, you may refer your complaint to the Property Redress Scheme, free of charge, within 12 months of our final response. Our membership number is PRS008911. Contact: propertyredress.co.uk, 0333 321 9418, info@propertyredress.co.uk.
13Your personal data
Our privacy notice explains how we use and protect your information.
14General
We may update these terms from time to time. The version in force when you book applies to your booking. If any part of these terms is found to be unenforceable, the rest still applies. Nobody other than you and us has any right to enforce these terms.
These terms are governed by the law of England and Wales. You may bring proceedings in the courts of England and Wales, or, if you live in Scotland or Northern Ireland, in the courts of the country where you live.
